This is horrific... but, the first thing that came to my mind - I'm sure SEAT BELTS were nowhere to be seen. Just a metal tomb where bodies get tossed around like packages. WHY does “Click It or Ticket” not apply to buses. School buses in particular - although Metro buses ought to require them also. Is it that seat belts cost too much money? How much is a life worth? The medical bills incurred in this crash could probably install seat belts in 1000 buses. The minimum ticket cost of an adult seat belt violation in California is $142 and up, and a minimum of $445 for not properly restraining a child under 16. If the parent is not in the car, the driver gets the ticket. Who gets this ticket?

I saw this happen. I was driving home from a concert (I have been sober since 1997) north on theRead More 405. As I passed the 101 I heard the sirens and saw the pursuit going around the cloverleaf. Stupid drunk, I thought, and I kept on driving as the pursuit was on the other side of the freeway. Traffic was very light and I was driving about 75 Northbound in the fast lane. Suddenly, across the divider on the other side of the freeway there was an SUV passing me going the wrong way. My first instinct was to speed up to watch him. But then I realized the danger innocent people were in and I slowed down a little bit so I wouldn't have to watch an innocent person get hurt. In my heart I started praying for the innocent people driving South at that moment. Just ahead, there was a tiny hill, and I couldn't see any oncoming headlights because of the hill. The wrong way driver's SUV disappeared over the top while I kept driving and praying. When I crested the tiny hill my heart stopped because I didn't see his taillights anywhere, but I could see what looked like steam or smoke on the other side of the freeway. There was a destroyed car on the right side of the freeway and another demolished car in the center divider. I didn't want to see that, and I'm hurting because of it. As I continued North, it seemed as if the helicopter overhead had turned around and was lighting up the accident scene. But there were more cars coming south, unaware of the wreckage just ahead of them. I felt awful, I wanted to warn them somehow, but I was powerless to do anything. I thought about getting off the freeway and getting back on the south side to try to slow people down, but I couldn't think of how I would be able to do anything other than get myself killed. I kept praying and I cried as I drove. Then I saw CHP on the other side of the freeway swerving back and forth to stop traffic. That was near Roscoe, and I got off at Roscoe since I live near there. My heart hurts for the innocent people hurt and for the baby especially. I don't mean to sound selfish, but my heart also hurts for me. I didn't want to see that and I can't get it out of my head. Maybe my prayers helped, maybe they didn't. Yes, there was an accident, but the innocent people are still alive and so I will thank my Father in Heaven for that. I'll continue to pray for the family, and if anybody wants to join me in that, will you please pray for me too. I would appreciate it.

There may or may not be some liability on the part of the second driver, the one who struck the twoRead More men, as far as whether or not that driver could have avoided the accident. HOWEVER, because the first driver was intoxicated AND driving in the wrong direction, the full liability will likely fall on THAT driver, due to his actions having caused the initial accident, as well as setting in motion the chain of events that followed. It’s a simple “but for” legal analysis. “But for” the actions of the first driver, the initial accident as well as the second, which caused the man’s death, would not have occurred.

This is tragic and it happens more often than you might think. It even has a name - multipleRead More threat. It happens when the view of the pedestrian is hidden by the car that has stopped and the car in the next lane over doesn't see that there is someone trying to cross the street. Even though the pedestrian has the right of way, you can't be sure other approaching cars will see you. If you are ever crossing the street, in a marked or unmarked crosswalk, and a car in one lane stops for you, never assume the cars in the next lane over will see you and stop. Always stop and peer around the the car you are crossing in front of to make sure there's no car approaching in the next lane. If there is a car approaching, make sure they see you by making eye contact with the driver and be sure they are going to stop before you proceed. Hopefully this advice will save someone's life.
